Cheque bounce case in uae

Dear Sir,

Mr. V T George Sir. i was very happy to read this in gulf new website, but today that is on 2nd january 2013, they say that it was only for uae people (nationals)., is there any reasion for this change in statement. i think pressure from people who has shares of banks. sir do you know anything why they change the rules in just one day after making a statement. please if you have any information please tell me. also i just want to take your suggestion, that if a uae bank files a complaint agains me in india and he goes to court and court calls me and i am not in a  position to pay what can be the possible punishment that court can give to me. i dont want to think negative but i should not close my eyes toward facts. please if you can guide me i shall be thankful. regards.

As per Gulf news dated 02 Jan 2013, this rule was made applicable to expatriates. But on 03 Jan 2013, the rule is changed.  In November 2012, the President issued a decree making this rule applicable to nationals. Now in Jan 2013, His Highness, the President issued decree making it applicable to foreigners also (as per press reports). Today, the rule is limited to Locals only. Expats can still be arrested if they are in UAE. The paper do not say that the report of yesterday was wrong . That means , it was corrected. In UAE the press cannot report like the press in India. Slight restrictions are there. Though not a press sensorship. If cheque is issued for business purpose and bounced, it is criminal in nature. What I understand ( I may be wrong)  is that it takes INDIA government's prosecution sanction for filing a case against you in india. That is a long process. It needs a verdict in UAE and then to take the verdict to Indian Embassy and then to Foreign ministry in Delhi and then to Home Misnistry and then to your regional court of the State. You can imagine how long it can be !!!! What I understand is that the case is civil in nature (??). So it becomes attachment to your property or assets. So my advise is to leave this aside now and continue with your life. Forget this issue  for the time being and you proceed with your life. If any case officially comes, then get an advocate to challenge it. Indian Judiciary is still the best system in India. So all good wishes.

The rule of exempting Expatriates from arrest on Guarantee Cheques was a shock amongst the local nationals and Banks in UAE. Naturally that had an impact. Unlike in India , in UAE , decisions are taken by one person and so it takes hardly one minute to decide.

Respected Mr. V T George sir, i am extremely grateful and thankful to you for sparing time for me. honestly my soul is in extreme distress since i took money from this banks in uae, and this is because their agents approached me with a loan offers, which resulted me to think and imagine myself more than my capacity (of acquiring loan and handling finance), saying this i cannot  shed my responsibility of great mistakes ( in clear terms the " SIN " ) i have committed by taking or accepting this loan offers. they came to me one after another and i kept on accepting it.... till the extent that one fine day i found myself under the huge huge mountain of debts, which at this time require a miracle to come out of. this is the very reason that the religion i follow prohibits any person " To lend or borrow money on interest" but here i did a greatest sin by accepting money on interest, despite knowing that this is prohibited in my religion, and finally this is the punishment i am facing in life, and i am also scared that even here after (after my death) i may have to face the wrath of my Lord for disobeying his orders. all i request you and all the readers of this forum to kindly pray for me. only God can pull me out of this, and i am sure sure sure sure that my god will forgive me. please my god forgive me,i beg you, my god please forgive me and help me come out of this debts. give me strength and resources to come out of this debts. please please please.

Dear all,

Firstly I thank everyone in this forum for contributing with valuable information. 

I have a similar incident that happened back in 2010. The story goes like this. - Unfortunately due to some unavoidable circumstances / reasons, I was deported from the UAE, and couldn't fulfill my promise to the bank of repaying my personal loan, which I was paying till the time I had a job, and till the time I was in the country.In fact, I left a good sum in my bank account, so that as long as possible, I could fulfill my payments to the bank.

Now its been 4 years since this incident, has happened, and I am living here in India, working very hard to re-build my life back. But since 2 weeks, I have been getting calls on a daily basis from a third party agency in Dubai, who have branches in India, .The agency only knows my total outstanding amount, and does not acknowledge the payments that were made. They are looking at recovering the full amount (Principal + Interest), and are threatening me that they will take legal action against me in India. 

I have been co-operating with them, and have been asking them to look into my account, and see what has been paid, and how much more needs to be paid, so that we both can mutually arrive at a negotiated amount and work towards closure of this issue. But they are not willing to share any documents, and only prefer talking over the phone. They just want an email from me stating the amount I am willing to pay. So I sent an email stating the amount that has already been paid, and that I would not be able to afford to pay up as per their demands, and I am keen to negotiate. 

I had also sent one of my trusted sources to the bank, and he was only allowed to meet 2 people, and no one else. According to my sources, the bank has not yet bounced my cheque. Its been 4 years now since I have defaulted on my payments. I owe them close to 200,000 (according to them)

i would like to know, how much of a legal influence does the bank, or the bank's agent have here in India? 

Am I liable to be tried in India for a financial crime made in the UAE?

Can I file a complaint against the local collection agency if they continue to harass me in India?

Can I offer them a one time settlement figure and tell them to take it or leave it?

I would not like to be dragged into a case, but prefer to mutually settle it with the bank. And if I fail to settle it, what are the risks involved?

This is a local bank based in the UAE, and has presence only in GCC.
