Hello sir!

If you are cheated out of money, an act of fraud has been committed. A fraud is an act or omission which is intended to cause wrongful gain to one person and wrongful loss to the other, either by way of concealment of facts or otherwise. Fraud is defined under section 421 of the Indian Penal Code and under section 17 of the Indian Contract Act.

Under section 421 of IPC, such person would be punished with an imprisonment of a term which can be extend upto two years, or with fine, or with both.

Section 447 of the Companies Act, 2013 provides punishment for fraud. It says that if an individual is found guilty of fraud he can be punished with imprisonment ranging from 6 months to 10 years. He shall also be liable to fines ranging from the amount involved to three times the amount involved in the fraud.

(In case the circumstances of the fraud are against the interest of the public, the wrongdoer can be punished with imprisonment for a minimum period of three years.)
