Contract labour outsourcing business

Hello Namaskar to all,

I have started my new business of OUTSOURCING OF LABOUR/MANPOWER IN HOVT INSTITUTES VIA GOVT DEPARTMENT OF HIMACHAL AND UTTRAKHAND.

Requested all pls guide me :-

1. What documents i have to maintain.Pls supply formats.

2.Whats license/certificates etc documents i need  to start and run my business.

3.Whats rules and regulation ,i have to follow under compliances.

4.Any software or excel sheet, to keep record of employee and file epf and esic return.Pls share link.

5. Pls suggest any good book that i read about contract labour laws/compliances etc.

In response to your query,

Outsourcing is not officially regulated in India. Certain rules, however, govern outsourcing in specific industries. And there are different laws in India to regulate specific sectors-

  • Indian Contract Act 1872.
  • Indian Stamp Act 1899 and the applicable Indian state stamping laws (Stamp Act).
  • Specific Relief Act 1963 (SRA).
  • Code of Civil Procedure 1909. 
  • Arbitration and Conciliation Act 1996 (Arbitration Act). 
  • Foreign Exchange Management Act 1999 (FEMA). 
  • Information Technology Act 2000 (ITA). 
  • Intellectual property laws.

You must take a look at these important statutes with the help of a suitable lawyer and understand from him exactly what documents you will have to maintain inorder to not violate any rules.
