Conveyance deed of society

Hello,

 

It is regarding conveyance deed for society.

 

We are from Kharghar (Navi Mumbai ). While builder developed the building, he had executed development agreement between Cidco/Landowner.  which is not registered and not paid stampduty for that agreement. Bulider gave 6 flats and 1 shop to land owner for this deal. After that he developed the building and sale remaining flats to all of us.

As building members, we formed a cooperative society at last year (24/04/2011). Prior to register the society “Joint Registrar” sent three notices to builder but he didn’t respond and “Joint Registrar” registers our society.  

Now society want to do conveyance deed (Land transfer) to the name of the society which is still on “Gaun wala” Land owner’s name. 

 

As a action, We (Society) had sent two letters to builder regarding land transfer to society name but builder is not even responding to them. Therefore we are in dark that what would be the next step pertaining to this?

 

Someone told us there is concept of deemed conveyance deed, where builder/landowners are not required. Could you please advice what is the right way from here?

Since the society is formed you can go for deemed conveyance but remember you will have to pay stamp duty and other charges as the procedure of deemed conveyance is not easy and requires service of specialized person which are not small amount and to save this money your builder is avoiding doing himself. Hence if you are not in hurry of getting conveyance then consult with a impartial consultant who will give proper advice for cource of action which will save your money and time. Try finding legal way to comple your builder to give conveyance as this is the best and proper option still. i have came across some peoples who were arguing why law of deemed conveyance was brought instead once society is formed the conveyance should have happened automatically without any much procedures.

It is absolutely correct tat after forming society conveaynce should be given automatically but politition & builder nexus prevent it by creating such laws which they themselves benefit. Flat holder is purchasing flat alongwith the share of land. That everybody knows but all the flat holders should pressurised the builder to tranfer title of land in the name of the society. The government should change the law Maharashtra  Co-operative society  Act , 1960 where while forming the society stamp duty for conveyance should be taken and also conveyance should be effected.
