Cooperative housing society

Hi

We have (Gated Community) Cooperative Housing Society Registered Under Telengana Housing Scoiety. There are 252 members, and most of them (more than 80%) are no residents. Around 100 Houses are occupied by Owners and renters. Out of 252 houses 50% are not paying maintenance because of some reasons.Society has sent legal notice to all non payers

Recently we come to know that, the Formation of  our Cooperative Scoiety is based on forged signature of some members (Not All), Though they are staying there, but on document Signatures are not of them. It was Signed by Agent who helped to completed the document (As said by President/ VP/ General Secaraty/ Tresurar whose signatures are original on document).

Some Executive member of the socity are permanently living in USA (Not sure if they are Citizen of India).

There is a Bank Account opened with same document for all maintenance activities.

Does it mean that the Society is Invalid, and bank account can be freezed?

Thanks

Sudip

To check misappropriation or mismanagement of funds in cooperative housing societies, the state will introduce a new provision in the Maharashtra State Cooperative (MSC) Act, 1960, allowing an auditor to register a criminal offence against office-bearers guilty of financial misconduct.

In a move that will have far-reaching implications for cooperative housing societies, the state government has tightened norms against misappropriation or mismanagement of society's funds. You can submit your grievances to the registrar of cooperatie socieities. He will enquire and take suitable actions.
