A Trademark means any symbol, word, name, device, numerals or combination of both, which can be represented graphically can be registered as trademark. A trademark is unique symbol which distinguishes your goods or services from others. A Good Trademark shall be easy to speak and remember despite of which, it should not lose its uniqueness and distinctive character. Decision of a consumer approaching for purchasing any goods or hiring services are highly influenced by the Brand Value and reputation a Brand Name holds. A Business registration means to register one’s organization under various Government Authorities under different ACT and LAW. A business can be registered as a Proprietorship Firm, Partnership Firm, Limited Liability Partnership, Private limited Company, Public Limited Company, Trust, Society. The registration will be based on the type of one’s requirement.

A trademark identifies a product or a service in the marketplace and it is used to distinguish it from other products and services. Trademark registration requires the ownership of intellectual property, rights to exclusive use of registered trademark and legal protection in case of trademark infringement. Some examples of trademark registration are words, slogans, business names, numerals. The process of registering a trademark takes more than 12 months. If the trademark registration is not obtained the name of the business can still be used by others. 

A company registration is the creation of a separate legal entity or an artificial judicial person. It is established under the Companies Act 2013. It creates a business entity that is capable of entering into business transactions and ownership of property. The Companies Act of 2013 mandates that a company name should not be similar or identical to a registered trademark.

trademark registration is an intellectual property registration under the Trademark Act of India whereas a company or LLP registration is an artificial judicial person under Companies Act 2013. Trademark registration process takes about 12 months whereas a company will take 20 working days to do the same. When a company gets registered it receives a certificate of incorporation and once a trademark registration is done, the TM symbol can be placed next to the logo or the name of the business. No company can have a similar name to a registered trademark.
