Difficulty in obtaining noc from a bank

Respected Sir / Madam,

this is regarding possiblity of forming registerd society where there are only 8 members and NOC from bank.

Builders are dead and the firm is closed down. Building is more then 12 years old. It has 8 flats. No share certificate are issued . 2 flat owners do not live in Pune. 1 flat owner has been mentally sick and is admitted in a mental hospital.

One flat owner says that with 8 flat owners we can form a" registered society."

1. Is it possible to form a registered society with 8 members?   And is it also valid ? He takes care of maintenance . He says we need to pay ( total amount)  Rs. 40000 for society registration.(!)

2. As a flat owner, I would like to sell my flat.  Buyer needs NOC from a Bank to get a loan.  How and from where can I get NOC ?

3. Can I get a legal document or proof that will help the client/ buyer to get a loan?

The NOC will be given by the society but since you have not formed one, it is better to form a society as per the procedure and for procedure you may take the help of a local consultant or a lawyer who will be able to guide your properly
