Exhibit presented in a civil case found to be false after the judgement passed

If an exhibit presented to the court is found to be fraudulent after the decree is passed, how can one go ahead with it. Can the respondent contest the same at a later date when he comes to know that the plaintiff has submitted exhibits with false contents and on the strength that the plaintiff is a statutory body. Also can the repondent get a copy of the exhibit from the court. How to apply for it?

File appeal against trial court judgement and argue that plaintiffs documents are false or concocted and to allow appeal with costs.

The respondent was given an opportunity at the time of marking of documents or even during cross examination to prove his contention about  the fake documents, if you have not utilised it and remained silent then you may not be able to establish the fact even in an appeal.

However nothing prevents you from preferring an appeal against this.

You can file a copy application before the same court seeking for certified xerox copy of the documents in question

The judgement was in our favor. We werent aware that the exhibits were false we came to know when we verified the exhibits personally. Thank you all for your responses and advice.
