Where there is offer and acceptance that is contract under Contract Act

T. Kalaiselvan, Advocate (Advocate)     20 November 2024

a sale agreement is covered under the Sale of Goods Act, 1930, which is based on the Indian Contract Act, 1872:
Sale of Goods Act:
The Sale of Goods Act governs sales contracts, and the basic provisions of the Indian Contract Act apply to contracts of sale.
A contract of sale can be either a sale or an agreement to sell:
Sale: The seller transfers ownership of the goods to the buyer for a set price. Agreement to sell: The seller transfers ownership of the goods to the buyer at a future date or when certain conditions are met. The agreement becomes a sale when the conditions are met or the time has passed.

Yes, a flat sale agreement falls under the purview of the Indian Contract Act, 1872, which governs the formation, validity, and enforceability of the agreement. The Indian Contract Act provides the foundational principles for all contracts in India, including those related to property transfers.
