FORENSIC REPORT

Ld Members

I wolud like to know whether Forensic report submitted by some Pvt Organisation who claimed to be govt regd Forensic Expert Organisation is accepted in the court of Law.

How one can be sure whether such organisation is really regd with govt and what basis

kindly send me any case ref / Notification/ rules in this regard

A report submitted by a Forensic Science laboratory or any other laboratory as defined under Sec 293 Cr PC is admissible as evidence. All other reports by any expert whether recognised or unrecognised is considered under Sec 45 of Indian Evidence Act. A perusal of Sec 293 Cr PC would enable you to know whether the said expert's lab or organisation is listed as Govt or not. Further their are organisations which are registered under Societies Act and funded by Govt of India which give reports to Courts but they all fall under Sec 45 of Ind Evi Act.For your query refer to DNA cases decided by the Apex Court wherein my evidence was considered.
