House tresspass

Hi

I and my husband is living on rent from March 2024 with proper rent agreement. Landlord gave us two keys and kept one key with him without telling us as he wanted to sell house .

He started showing flat to people from June onwards and in July aug sep he gave third key to management and they showed flat to people without taking our permission when were not on flat ie tresspassing.

I got to know about this from cctv in sep and at that time they requested not to escalate this matter .

Now he is asking us to vacate flat as he has got buyer , what should I do now ?? A police complaint

What is the period of the rent agreement and what are the conditions in the rent agreement?

From May 2024 to April 2025 .

It has one clause that if owner wants flat he can take back by giving one month notice.

As per the agreement, did the owner give you notice one month in advance?

Today he has just given a WhatsApp message to vacate flat by next month

You can refuse to vacate the flat for the reason that you are not able to find a suitable house for rent.

This way you somehow manage to dodge him till the expiration of the rental agreement period.

If he is forcing you then you can approach court with a suit for injunction against him to restrain him from forcibly evicting you other than by due process of law

This way you can stay there for another two years or more.

Ok thank you sir , and what should I do for them tresspassing my flat without my permission when my all materials were in flat .

T. Kalaiselvan, Advocate (Advocate)     12 October 2024

You can lodge a criminal complaint against them for trespassing your house and include that some items have been stolen by them which will add strength to your complaint

file injunction suit, to follow due process of law in evicting and not by force lodging police complaint will be helpful to the case, but u have to prove ur legal possession.

Ok thank you !!
