How get claim amount

Good evening to all,

Respected Advocates,

In 2012 i purchased private LPG gas dealership for rohtak district from private alwar based gas bottling plant i.e. prachi gas bottling. Now in 2015 they stop delivery of gas cylinders and also take advance payment as security amount 8 lakh and licence Rs 2 lakh and 20 lakh for 600 cylinders and pipes etc. 

In 2015 they offerd us to all 600 cylinder and other item to the alwar plant and surrender your dealership ,,,thereafter all amount refunded.......i did all what they said but nothing recoverd.

then we hire advocate of punjab and haryana High court where he assured us that high court will orderd them to repay your all amount within 2-3 years of case but now 6-7 years passed ..no any order passed by High court and my advocate said that now no recovery is possible....becaause it is criminal matter for which they already in jail from last 6-7 years.

he also suggest us to file local FIR in rohtak distrcit and to continue case in Rohtak district and sessions court.

 

my query is that can rohtak court pass in our favour or they just do criminal trial over accuseds.

someone suggest me to file civil case for which there is stamp duty of rs. 3.25 lakh rs. and also recovery is not assured.

 

so pls kindly suggest me what should i do for getting my amount without pay any stamp duty.

 

actually there are 30 dealers from haryana who filed case against them for recovery of 1500 crore rs. in high court.. but till date afetr 6-7 years we got nothing.

Since the matter is pending before high court you may have to wait for the disposal of the case by high court.

If the accused are in jail then what is the use of lodging a criminal complaint against them that too at this belated stage.

It wil be consireded as barred by limitiaton if you plan to file a civl suit for recovery, hence better pursue the high court case itself
