There is a issue with one of the people at rent at my place and he has been there since 2001, the Place is in bangalore near majestic.
The property, which is a shop, was given as a rent to him by my grandfather who has now passed and the property is legally in my mother’s name.
The person is not honest and he never used to increase the rent according to the law and we get a rent of about 4,000Rs whereas the ruling rent in the area is about 15,000Rs and above as per the revenue officer.
He did not agree to increase the rent so we asked him to leave, and he told us that he needs the advance that he paid. As per our knowledge, the advance paid is 7 Lakhs. But he tells us that the advance is 12.5Lakhs, which is not true.
We searched for the rent agreement, but could not find it so we are left with no proof on paper that the advance was 7Lakhs. I’m sure the guy staying for rent has the documents but is not ready to show it to us and tells us it’s lost. He told us to go to court.
How can we tackle this issue in the court, since the guy staying for rent always pay’s it after 20th every month, he is really rude and does not respect the owners to the bare minimum.
Please advise.
