Leave and licengce agreement

Hi, 

I have a commercial property and have been giving the same on rent under Leave and Licence agreement from last 9 years to the same individual, renewing it after every 3 years, i.e 3+3+3. Does such arrangement gives tenancy rights to the licencee????  As I have heard that as per law giving a property to same individual on rent for more than 5 years, under L&L agreement gives him tenancy rights over the property.....Kindly advice
