My company's working hour is from 9:30 am to 5:30 pm (including 1/2 n hr break) for 6 days. In my comapny we follow Bombay Shops and Establishment act.
Now for claculation of OT hours we consider OT payment only if an employee has worked above 51 (48 hrs duty plus 3 hrs lunch break). The logic is suppose an employee works for 55 hours then what we do is 55 hrs - 3 hrs ( 1/2 hr Break time in a week)= 52 ( so actual excess worked hour is 1 hour (52-1).
now my question is whether OT to be considered after 48 hrs inclusive of break time or exclusive.
