Please help. . .

Property 1 & 2 are owned by an individual. He sold Prop.1 to a person excluding a portion of land for pathway. He included a clause in the sale deed that the pathway can be used for a third person. Now, Whether the Owner of the property has the right on that pathway? The Owner sold Prop. 2 to a person. In the sale deed there is a general clause to include all the pathways. The same property was further sold. But, in this sale deed there is a specific clause to include the pathway. Does the final purchaser has the right on this pathway?

The ultimate last owner can enforce easement right.
