hi sir  my mother died in july 2012 the house which we are living is in my mother's name.my father make documents to transfer it onto his name i have only 1 sister we both sign that documents beliving that he is our family head but now is planning to remary at the age of 67 which we strongly oppose to avoid unwanted shareholder in our mother's property. how can we avoid the name transfer we are living in mumbai so please guide us My email id is    hlkhmd@gmail.com

you need to send a legal notice to the society through an advocate asking for not to transfer the share certificate of the flat in the name of your father.

 

further, a  copy of the same needs to be sent to the sub-registrar of the co-op. society too.

 

you need to file your objection in the testamentary petition, if filed by your father.

U give a application in Society/Company/Association for that and without your consent they are not trasfer this property another person. You give a public notice for that without our consent if any person purchase this property.
