Dear Sir/Madam,
My name is Satheesan, native or Kannur, Kerala State.
We 3 brothers, one is 3 years my elder and the other one is 6 years my younger, jointly purchased a land Kannur in the year 1996 and constructed a house in it during 1996-1999. We are from a poor family and whatever earnings we had, we never kept for individual use. All of our earnings were spent jointly for our family's happiness. However, after construction of the house, both my brothers together with my Babi attempted to keep my family away from the house, while I was away from home. Aalso telling that there is no right for me or my family to stay in this new house. And my wife and kids left the house and went back to her parents home.
Now my brothers are asking me to write off my share in my house / land which we purchased and constructed together. The land and the house are registered in all we three brothers name. My brothers are telling that, I did not spent anything for this land and house. And my younger brother says, he have bank transfer details of the fund he transferred to my Babi's account for house construction since he was in abroad. Eventhough, I had deposited fund equivalant to 50% of the land's value, to my Babi' s account the day we registered the land I am very much discomfort to announce such accounts among family members. I also spent some fund for the house construction, from the day of foundation to housewarming day. Unfortunately, I have no such bank transfer record with me, as I was in India during this period and I spent myself whereever we need fund for the construction of the house.
Now, they are forcing me to quit from the house, telling that I have no right in this house / land using all bad words, adding that the land is purchased and the house is constructed with their own fund.
I repeat, the land is purchased / registered under registrars office under three of our name. Also the house is constructed under 3 of our names. In this case, how can they quit me from my home ?
What kind of action should I take to get justice against this cruel attitude of my brothers ?
It would be great, if any one can guide me on it.
