Registered land

Dear Sir/Madam,

My Father bought a land in 1991 in the outskirts of chennai and registered in my mothers name, After 3 years my father and mother got divorced and my father later reregistered the land to his two sons (One my big brother and second is me) without the consent of my mothers notice.

As my mother is suffering financially i wish to give the land back to her.

My question is as below

1. Whether the land can be registered to sons name without the knowledge of my mother

2. Now i can understand that the documents bear my name and my brother name.

Please kindly suggest your ideas how to proceed further.

Your father can not transfer land to your name until your mother sign the necessary document. If she is owner then only she executive the instruments of transfer of land.

Transfer of landedp property by your father in your name without the consent and express written permission of your mother or without a deed of sale executed by your mother in favour of you is invalid and illegal. You will not get the ownership rights of the same. Till date your mother is the legal owner of the land in your possession. And your position is illegal occupent liable to be evicted by the real owner at any point of time though the process of law. A perso who has title cann't convey the good title.

I have done sale agreement of house worth 37 lac and I have paid him 5 lac by cheque at the time of agreement now he is unable to give required documents of house he is telling I 'll give you day after tomorrow we have done agreement for 90 days period in which 70 days has been completed I have told him give my money back but he is saying he don't have money and he will do registration only after that before 4 days back he told he will sell house in 47 lacs I cannot understand what I have to do can I do another agreement of sale for 120 days or it is not required because if 90 days completed shall he will don't give amount back any suggestion he faced some losses and he don't have money he has two houses on his own name any suggestion please
