Registration of a public charitable trust

Hi,

We are plannin to start a public charitable trust at chennai and would like to know the procedures for registration or creation so that exemption can be claimed under section 12 of the Incometax Act, 1961.. please help us in this matter.

Dear Aparna , To form a Public Charitable Trust it is essential to prepare a Trust Deed. The Trust Deed should incorporate the following 1. The name(s) of Settlor(s) of the Trust 2. The name(s) of the Trustee(s) 3. The name(s) if any, of the beneficiary/ies or whether it shall be the public at large; 4. The formation of Trust or the name by which the Trust shall be known; 5. The place where its principal and/or other offices shall be situated ( the address); 6. The property that shall devolve upon the Trustee(s) under the Trust for the benefit of the beneficiary/ies; or the amount of money being 7. The intention to divest the Trust property upon the Trustee(s); 8. The main and ancillary objects of the Trust 9. The management of the Trust. 10. Role and Powers of the Trustees 11. Meetings of the Board of Trustees 12. Resignations and Appointment of Trustees: 13. Indemnity and Compensation of the Trustees: 14. Appointment of a Protector of the Trust: 15. Bank Accounts and Management of Income and Funds of the Trust: 16. Dissolution of the Trust: Registration is to be made as per the provisions of the Registration Act, 1908. It is pertinent to mention that the Trust Deed and not the Trust has to be registered. The deed has to be registered with the Sub-Registrar of the registration department of the respective State Governments, in your case state of Tamil Nadu.

You can register yor trust at ass. cherity commissoner offfice, U/s 18 of bumbay public trust act.

The forms are provided with the Municipal Charity Commissioners Office located in the respective District and you are suppose to make the same documetns provided according to the formats therein along with two sets signed by three (President, Secretary, Treasurer) in all the papers with an Affidavit by Presidents than the Numbers are given then have to appear before Charity Commissioner with the Applicant i.e. President and Charity Commissioner will pass the Order thereby registering the Trust and paying the fees on the respective dated provided in the Order.
