Stamp duty on sale of property

Hello dear Forum members,

My friend (A) purchased a plot in urban area (district head quarter) from purson (B), which was just put some walls, and after purchase he constructed the double storied building.

after more than a year one person (X) came and complaint to sub registerar stating that he made an agreement of sale with that owner (i.e. previous owner i.e. B) for purchase of that property (i.e., plot and consturcted building), and complained that the building was pre existed before sale deed.

 

Sub Register is asking the purchaser to produced the documents to prove that the plot was open at the time of purchase.

Sir,

I would like to know that what documents is to be subimitted to prove that the plot was open at the time of purchase.  

Please guide us in this case.

The descripttion of the property as per the registered Sale deed will throw light on the fact whether any building pre existed on the parcel of land in question. Other circumstancial evidence  to prove pre existence of building over the plot would be 1)existence of holding tax receipt issued by municipal authority ,20 electricity  & water supply connection letters etc.issued by respective authorities issued prior to the date of execution of Sale deed.

thanks for your reply,

but sir, I think electricity and water connection can be taken if a small hut or temporary shed is there in that, it is not compulsory that to get water and electricity connection a permananet structure should be there.  Is there any other method to prove that the plot is open plot.

Municipal authority fix holding tax dues considering the construction made over the plot , so you can obtain info from them. Besides, if you have applied for mutation of land in your favour Revenue authority prepare a Revenue Inspector's Report on the basis of field inspection report submitted by Amin, such records would be available inthe records of concerned Tehsil.

I would like to know from you and other forum members and experts that: 

 

Whether mutation means change of name in the land/plot records?  If it is a city whether it is a muncipality or Revenue? If it is extended area city area who will be?
