Sublet agreement

To

The Respected senior experts

A(owner of Shop) made an Agreement with B(a 100% State Govt Co) for 3 years

In agreement there is a sublet clause (ie  B can sublet the shop to anyone)

Now B sublet the shop to C by another separate agreement for 2 years. in this agreement can B insert a clause:

'C  have to deposit (equivalent to 2 months rent) as a security deposit to A (original Owner) which will subsequently be adjusted with the rent payable by C to B(100% State Govt Co).

This is because , initially A claim advance from B. But B being a Govt Company are not allowed to give such advance payment.

Simply to avid this can the clause allow such indirect payment.

Regards

Abhijit

If the original tenant is government then how can they insert the clause which is against the government rules, you may first of all get the sub rent agreement properly  scrutinised by a local lawyer and proceed only if it is feasible and do not cause any injury to your interest.
