Succession Certificate

dear sir,

can one obtain succession certificate from the court while the person making a will is still alive or during his/her lifetime.

pl let me know.

No! since a will comes in to effect only after its' testator dies and not during his life time therefore no beneficiary has right to apply for any sucession certificate during testaors life time.

DEAR SIR! 

iTS' always better keep facts before adviser than to make questions.

Any one can apply for  a succession certificate who claims to have inherited any property from a deceased irespective of one  having tastated any will of properties  one owns.

Without a cause of action no suit lies. Thus because before death no cause of action arise, hence can't apply for succession certificate.

Will comes in to opertation after death of the executant and succession certificate wont be issued during the life time of the executant.
