Succession certificate

Hi,

My grandfather had purchased a property 40 years back. He had not prepared a will and after his death my grandmother had applied for transfer of flat ownership rights from grandfather to her,since she is the legal heir. Death certificate and NOC of her two childrens have been given to the society,but the society is demanding of succession certificate. Is their demand valid and if yes than under which section of Co-Operative Societies Act??? If we apply for succession Certificate in Mumbai High Court than what will be the Legal Fees.

Had your grandfather filled up the nomination form in the society pertaining to the said flat????? if no, then you need to apply for the legal heirship certificate before the High Court for transfer of the ownership in the said flat in the name of your grandmother.

then you would be required to apply for legal heirship certificate before the High Court at Bombay.

What will be the charges and how much time will it take for court to issue this certificate

As per procedure Court generally takes 6 months for issuing the certificate.

What is the diference between the heirship certificate and the Succession certificate ?

In mofussil areas heirship certificate is issued to the applicant by the concerned Tahsildarand it serves the purpose of the succession certificate. How is that ? According to my knowledge no stamp duty is required to be paid for applying for heirship certificate to the Tahsilsidar,except the the court fee stamp of Rs. 5/- 0r 10/- But in case of succession certificate one has to pay stamp duty  on the basis of the value of property  to be inheritated by the legal heir/ successor. can anybody enlighten me on the above subject ?
