So far we do not have a law on the subject.

Government of India is has decided to pass "the new Assisted Reproductive Technology (Regulation) Bill & Rules, 2008," which legalises commercial surrogacy, stating that the surrogate mother may receive monetary compensation for carrying the child in addition to health-care and treatment expenses during pregnancy.

You don't have to do anything specially to make the agreement legal. As such, surrogacy agreement is permissible and legal as that of any other coomercial agreement and registration is not compulsory.
