Accused released on bail but property document is not satisfied

Hi All,

Accused granted bail & released after submitting solvency certificate and property documents. After that, there was verification of property by the police team. They saw the site. They approached the sub registrar office & found that that khatha of the property was not there in the system.

But this site was registered in 98 & we had a municipal khata. Now, the police team said they are not satisfied & will report the same to the judge.

Now what will happen? Can the judge give us sometime to submit another property or the accused will be again sent back to jail. Please advise.

The police has nothing to do with the surety submitted by the accused.

If the court has passed any order subsequently to verify the genuineness of the solvency then only the police can come into picture.

Let the police submit the report, you will get a notice in this regard, after that you can decide next course of action, you may discuss with your advocate and proceed as suggested.

Thank you Sir.

Now, the Police has submitted it has fake surety to the judge.

But, it is actually a genuine property. Only Khata was in the books of 98 & not in the subregistrar system. It was registered in 98 and my dad expired in 2001 and later in 2005 khatha was made on mom's name. Property tax receipt is on mom's name & it is paid regularly.

Im worried. Will the judge give any punishment to surety holder? And the accused will be arrested again. Pls let me know your views
