the said doctor refused to identify the said woman. i saw it in tv. therefore the authenticity of the news is doubtful.

doctor may not say it publicly but he should inform it to the police or other authority.

as he hided the fact, therefore the authenticity of the news is doubtfull.

DOCTOR CANNOT IDENTIFY HER PUBLICALLY as per medical ethics. but such cases need a remedy.

there is a supreme court ruling that even a person may be arrested without offence, if the person attacked by AIDS.

I am not sure that anyone has a right  to arrest PLWHA.  Unless we read the entire judgement,  we do not know in what context such judgement was delivered. Non- discrimination policies with emphasis on protecting human rights of PLWHA are now in place in India. 

However, the woman concerned is a grave threat to public health and should certainly be checked by the appropriate authorities. If she is a psychological  patient , she needs to be admitted in a mental care hospital under strict supervision and not let off  on the streets till she has been rehabilitated psychologocally.  A spirit of revenge and her mental state  cannot justify her actions which borders to psychopathic tendencies.

what is PLWHA?

the question comes as, whether without any offence a person be arrested? is it not violating the fundamental rights of the person u/a 21,coi?

sc answer, yes may do in case of aids.

PLWHA is  a Person living with HIV/AIDS. 

It will be interesting to look into the context of the judgment. 

As far as I know, HIV/AIDS affected people are encouraged to have a normal life both at work place, home and larger community and they cannot be arrested just because they have HIV/AIDS. 

 I reiterate, however, what this woman has been doing comes under criminal activity as she is a grave danger to public health. Since she has been diagnosed as a mental patient, still she can be stopped by making her an in house patient in the mental care hospitals till she has recovered fully psychologically.

the person is a grave danger to public health - this was the ground.

i saw it in the pages of art 21 or 22 of coi.

Husband is guilty and wife is  guilty too.

There are many other ways to take revenge but sleeping with 300 men makes her a S*UT...she even didn't think about her son,what he will think of her.

 

Shame on these types of cheap Indian women.

making issues about a non-issue

She has a ten-year-old deaf and mute son who is in an ashram.

more important here is , is she  justified in knowingly spreading the disease?

she's a mental case...its proven medically

 

no normal woman wud like to s*x with 300+ men

 

she needs treatment,rehabilitation

 

also love and security by family

 

so that she stops doing all this..

if u feel she's doing "wrong" or "shud not do this",please meet her personally and tell her this.she will stop doing..

dear avnish, i don't know what of my post made you angry. i didn't know that she had a child, i simply asked the question. is she justified in spreading the disease? only time will tell

ok sir. i m not angry i just meant  admitted facts need not be proved .

 

yes every one has sympathy for her .
but no sane person will justify her act,

there were some recent reports of HIV infected needles in cinemas seats

no one can justify spreading this disease

yes agreed. it is also a common practice in medical labs in india to be careless with these things. harsher laws are needed to curb these things.
