Applicablity of Labour Laws

Dear all,

I am taking this oppurtunity to clarify who is responsible as Principle employer under Labour Laws:-A company X has been given contract as well as Buses to run the Bus service in the city by my firm.Under the contract agreement the Contracted agency is solely responsible for each and every mandatory obligations.As of now some seriuos violation on the part of contractor,accordingly pressure is also on us to comply labour laws.It is to be clarified pls whether my firm may be P.E.under labour laws.

Under Section 21 of the Act, in case the contractor fails to make payment of wages within the prescribed period or makes short payment, then the principal employer shall be liable to make payment of wages in full or the unpaid balance due, as the case may be, to the contract labour employed by the contractor and recover the amount so paid the contractor either by deduction from any amount payable to the contractor under any contract or as a debt payable by the contractor.
