Association sufficient or management society necessary?

Our apartment scheme consists of 5 buildings. The builder had made 3 buildings initially and had formed the owners into an association to manage it. Subsequently two more buildings were made at the location which formed another association to manage it.

The sale deeds were registred under Maharashtra Apartments Act. Deed of Apartment & Deed of Declaration were also registered covering all 5 buildings.

Since some time the bank a/c of the association has been blocked because PAN has not been issued yet. PAN has been rejected as a management society has not been registered to manage day to day affairs.

I met a consultant and he read the DEED OF DECLARATION and the Bye-Laws of the Apartments Condiminium and he suggested the following:

1. He said no further society needs to be made as DOD is already registered which clearly states the Bye laws for day-to-day management of the apartments.

2. For all 5 buildings have one President, Vice President, Secretary, Treasurer, and one normal member. Give copy of resolution to bank of the authorized signatories.

Questions:

1. Is above advise correct that we need not form another society for management of the buildings?

2. PAN application has been rejected 3 times for want of registered document of a society. Will PAN be allotted on basis of the DEED OF DECLARATION?
