Can public limited company file consumer complaint?

Hello Sir,

I am a legal representative in one MNC. My company bought one industrial machine i.e. Automatic Guided Vehicle for plant use. Now, the said machine has not been working since purchase as per specification narrated by the manufacturer. On approaching for replacement/refund, the manufacturer is not responding. Can I file a consumer complaint?

Your public limited company is not consumer as per the Consumer Protection Act 2019, therefore the company cannot bring legal action under the CP Act. Please refer the consumer definition from the Act.

The doors of the consumer forum is not open for those who are engaged in commercial activities, and that does not mean that the law closes eyes as it has several eyes all over the body.  Make a civil suit and MNC can afford such expenses, whereas it is not possible for a common man/individual who is treated as a consumer.

Yes, a public limited company is not a consumer.
