The Co-operative Societies were dignified in the Constitution of India by the introduction of the 97th Amendment to the Constitution of India. 

 

The 97th Amendment to the Constitution of India inserted the following:-

1.) Chapter: IXB of the Constitution of India is about the co-operative societies from Article 243ZH to Article 243ZT, which states the Incorporation, Number and Term of members of the board, Election of members, Supersession and suspension of board, Audit of accounts, General Body meetings, right of information to the members of the Co-operative Societies, Penalties in respect of offences relating to Co-Operatives Societies.

2.) Article 19 (1) c - insertion of "or co-operative societies" after "unions". Therefore making forming a co-operative society a fundamental right.

3.) Article 43-B which states that The State shall endeavour to promote autonomous functioning, democratic control, voluntary formation and professional management of the co-operative societies. Hereby making it a fundamental duty.

 

Co-operative Societies falls under entry 32 state list of the Seventh schedule of the Indian Constitution and hence is a is a state subject. 

 

The 97th Amendment to the Constitution of India has made forming of Co-operative Societies a fundamental rights and promotion, autonomous functioning, democratic control, voluntary formation and professional management of Co-operative Societies a fundamental duty.
