Compensation in case of uninsured vehicle

A car met with an accident by truck. The car was uninsured as on that date. The driver was dead on the spot. The driver was the brother-in-law of the owner of the car. Is there any supreme court decision in favour of the uninsured car owner against the Truck owner under the Motor Vehicle Act for compensation purpose?

U file suit for compensation if notgiven approach supreme court it may order for compensation. As per My knowledge the dependants may get compensation as it is purely accident.

If negligence of truck owner is established, the legal heirs of deceased would be entitled to compensation irrespective of whether car was insured or not at the relevant point of time.
