can you please clarify about Municipality Elections in Telangana..Any predominant rules or any judgements in this regard.

Sir,

As per Telangana Municipalities Act, 1965 ( S.13-B), any person having more than two children would be disqualified for contesting elections but there are certain exceptions to the rule-

  1. If the third child is born within one year of commencement of Andhra Pradesh Municipal Laws (Second Amendment) Act, 1994.
  2. If the children were born before the commencement of Andhra Pradesh Municipal Laws (Second Amendment) Act, 1994 and the number of children has not increased at the date of such commencement.
  3. If the Government provides for an exception.

Therefore, if the said children were born before 1994, no disqualification would be invited, if the number of children has increased by 1995, no disqualification would be invited.

If the children are born after the set date then the person is ineligible to contest elections.

You can refer to this link for a case law on the matter- https://indiankanoon.org/doc/751326/ - Bhukya Bujji vs Bhukya Saraswathi And Ors (Andra High Court).

Regards,

Nikisha Hada
