can there be any penal compensation on pre mature termination of employment contract by employee?

The due benefits what the employee would have enjoyed if he had completed the tenure has to be compensated by the employer in case of a premature termination of contract.

Pls correct if i am wrong

if the employee is workmen under labour laws then he  can claim


reinstatement and backwages


and if he is from management cadre then he can file civil suit for damages

Dear friend,


Any contract of employement will have a termination cluase binding both the employer and employee. If the termination clause provides for the notice period for termination of employemnt by the employer, then the employee can insist for the payment in lieu of the notice period provided if the employee is sent out of employemnt with out notice.
