Conveyance under the mofa act 1963

 
Hi,

I would like to know when a Hsg Soceity makes an application to a Builder for seeking conveyance under The Maharashtra Ownership Flats Act 1963, does it needs to pay any fees or financial remunneration to the Builder, assuming the Builder is readily agreed for granting the conveyance.

1.  There is no provision under the MOFA, to grant Conveyance of the plot to the Society.


2.  MOFA, only provides provisions / directions that the Builder should execute the Conveyance with 4-6 months and the relevant Punishment that would be applicable.


3.  In the instant matter, if the Builder is ready to execute the Society Plot Conveyance Deed, then the Society officer bearers and the Builder can do the same before the Registrar of Sub-Assurances.


4.  Typically all the Conveyance Expenses have to be borne by the Builder / Developer.
