Cropped marksheet filed by op in family court

Dear All, 

I filed GWA case in which court ordered OP to file marsheets of my children. However, OP is cropping the marksheet and report cards of the children to hide out the name and address of school. I have raised this issue orally with the family / trial court, but court is not listening to me. OP is giving excuse that they don't want me to visit the school and if I visit school it will create security issue for kids. I want to file a case of fraud / forgery / contempt of court in HC. I already know the school details but never visited yet. Please suggest what should be my next step.

Don't complicate simple things.

Your remedy that you are looking for is child custody and visitation rights as an interim relief, hence you may concentrate on how to get them instead of dragging the issue by approaching high court, moreover there is no reason for you to lodge the criminal complaint against her for the reasons stated by you, hence it will be a waste of time and energy and money to get indulged in such unwanted activities.

Yes, your focus should be on the remedy you are pursuing. However, unless in exceptional circumstancess, mother is entitled for the custody of the child; father would only be allowed visitation rights.

Addressing Cropped Marksheet Issues in Family Court

 

Firstly document everything meticulously, all the interactions related to the ,marksheet. Which should include all the times, dates and the content of the discussion with the court. Take a copy of the cropped document to be presented  as evidence. Write a formal complaint to the family court, this should include issue regarding the cropped marksheet ; where you have to explain that this obstructs your rights as a parent to be informed about your child’s education. To bloster your case attach the copy of the cropped marksheet. 

Emphasize that the OP’s action may amount to courts contempt by not complying with the court’s order to provide complete document. Consider filling an application to the High Court if you do not find a satisfactory response from the  family court. In this clearly articulate how there could be contempt of court due to OP’s action, by not complying to the court’s order that undermine your rights and the authority of the court. 

Since you are aware about the detail’s of the school gather any evidence that may help your case. That could include any testimonies from the individual who can verify the details of school. To resolve this issue amicably try mediation as a way to approach this situation. This will give both the parties a platform to discuss the issue and that may lead to a resolution without further escalation. 

You may effectively address the issue and take necessary legal remedies. Be proactive and persistent in your approach.
