debarred from tendering

We are service provider to State Electricity Board. We filed a money suit for recovery of service tax and other genuine dues from Electricity Board. The Board has now come up with a new tender for similar service for which we qualify but there is a condition that the participant should submit a undertaking that they have no suit pending against the electricity board in any court of law.

My contention is that justice was denied to me from Electricity Board and therefore i filed a money suit. Now again the Board wants to debarr me from tendering. Can this stipulation be challenged in court that the Board's intentions are to debar me from tendering. Whether I get justice from High Court and this tendering condition can be waived as i am the strongest contender of getting this tender and my right to participate in tender is being taken away by the board authorities.

Pl provide legal aspect in this regard.

Whether i will get justice from court and this particular tendering condition which debars me only can be waived?
