TAMILAN INDIAN (nil)     03 January 2024

Divorce (indian citizen filed at singapore )

Dear experts,

Indian citizens married by 2010 &  started their matrimonial life in Singapore . In 2020 husband found his wife who is in extramarital affair and filed for divorce.produced all telephonic conversations.  Singapore court gave a interim judgement mentioned " third party affair' and gave interim divorce order . since alimony is pending as they havent closed the second part alimony ( women charter as per Singapore law).

So can the husband sue her wife by giving a complaint in india  in women cell to find the third party . Also how to find the culprit. Is that necessary to file the divorce in india too to get validation for dissolution of marriage ( indian citizens only but filed divorce in Singapore.).  Kindly suggest for this.

1. How to sue (by giving police complaint)wife and that thirdparty who is in tamilnadu now.

2. Will they have to  file divorce in india as per article?

3. It is a contested divorce case.

1. The extra marital affairs or acts of adultery are not punishable in India hence no complaint will be entertained by Indian law enforcing agencies.

2. The Singapore court is yet to pronounce final judgment,  wait.

3. It will be known only after the judgment is passed by the Singapore court.
