dv 2005 needs help

 

What will happen for noncompliance of court order?

 

 DV act filed  sept 09  judge has given exparte orders( w/o po report) in feb 10  i have not received any summons now he forced me to pay 5000 pm.  Overlooking the fact that I don’t have own property & unemployed due to rti (s) raised by her lawyer on my company or residence of own still judge has asked to issue warrant for noncompliance of court order. session stayed his order opposition go to hc & hc stayed session order till next hiring . he is not waiting for final disposal by hc. case is running on a affidavit given by her. some part of it written by hand which is  out of that court judicary,do not know weather written after submission. 

 

Please do take time to answer these questions:

 

- How to avoid arrest when warrant is issued?

- Is it better to get stay order or to go for anticipatory bail?

- As judge has ordered issue of warrant for noncompliance of court order, if arrested can we get bail later on?

i already filed rcr in ggn court before her fake alligations . she filed first 498 than 125 & after that dv 2005

There is no bail provision, just you will have to pay the ordered maintenance amount thatz all, you can opt for the instalments.  If you didn't pay the amount you will put behind the bars.  DV act is not criminal case but it is criminal miscelleneous case.  No bail because it is not an criminal offence.  If you are already appeared in the High court then why don't you try for the stay of the proceedings of the Lower Court order.
