Efiling miscellaneous documents

Dear Respected Sir,

May I please ask if "miscellaneous documents" such as Judgement copies can be attached via efiling  https://filing.ecourts.gov.in to existing physically in-person filled CC cases incase such documents was missed by either of litigants. Will it analysed & taken on file after due approval/cost payment. Will both advocates be notified of such miscellaneous document before the court dates. Please enlighten

Regards

Vijay

If the case has been filed under e-filing and the case has been taken on file, if the case trial has begun then you may have to follow the procedures to file additional document as per the provisions of law.

Submit the document duly annexed with an appropriate application (which may be under order VII Rule 14 CPC or any other provision) through your lawyer, if you are litigant.

Service of such application / document is compulsory, it is better to serve the opposite party / counsel in advance.

Of course the applicant shall have to prove / justify necessity of such document before it is taken on record, as per terms (imposing cost or no costetc.) to be decided by court.

@ Vijay,

What is the opinion and advise of your professor / tutor / coach on the issue ?

Thank you Sir for taking time to explain. Much Obliged.

My tutor was apprehensive about the user manual of efiling website that mentions efiling of miscellaneous documents is entertained even for already filed petitions via paper physically(traditional method) as well as for electronic efiling.

This led to the confusion how would Hon'ble courts know about a new miscellaneous document in a traditionally filed case unless constant  checking is done on website.

Regards

Vijay
