yes. Either party can claim for their damages by issuing a legal notice to the parties.

in case the employee fails to pay which court to approach labour or civil ?

The employer needs to approach the civil court. However, it is unlikely that he will get a decree in his favour.

In the event of breach of contract by the employee, the only remedy available to the employer is to obtain a reasonable compensation amount. The compensation amount awarded shall be based upon the actual loss incurred by the employer by such breach.
