Enquiry about quashing

Hi Legal Team,

Is it possible to quash the magistrate court judgement in High Court. Or do we need to go for appeal in sessions court ? Pls advice on this.

Hello Friend,

Please note that if in case it is a final Judgement convicting or accquitng a person then you have to file an appeal to the sessions court, if the judgement is given by magistrate.

If in case the judgment is given by sessions court then you have to file appeal in the High Court. You cannot file an application to quash the judgement.

but if it not a final judgment and it an order given in any misellaneous petition then you can go for revision to the sessions and the high court.
