Filing case against public sector company

I received a punishment in domestic enquiry case in 2012. After that I got VRS in 2014. But I was asking the management to re examine the case from before the punishment and after the punishment to till date. Everytime management said it is already closed and the punishment was on par with the offence. But refused to re investigate the case or give their opinion or findings of the allegations and charges of 6. Recently they have given their opinion of the case and justified the punishment and challenged me to file the case in the court.  Based on this shall i file a case in the court. I am in chennai. I am ready to meet the lawyers fees and need a expert lawyer in chennai.

Thank you Advocate sir. Can you advise whether my case to be filed in local court or straight away writ at Madras High court.

It has to be verified from local lawyer as to whether subject matter against the PSU (employer) falls under jurisdiction of Central Administrative Tribunal or not.

Ok Sir. Since thousands of lawyers are in Chennai, how do I find a genuine lawyer and reasonable fees. Will I get any direction or advice sir

Firstly, you have stated that it was a punishment given by the employer on the basis of findings rendered by inquiry officer in a doemstic inquiry, why did you not prefer an appeal or take any legal action if you were innocent and the  punishment given to you was unjustified.

You could have approached court of law or even labor court with your grievnces seeking relief and remedy, instead you continued your employment for another two years after that punishment was meted out to you and had taken voluntary retirement subsequetnly.

Whereas you did not take any action for almost a decade after retiring but now you want to file a case in court, what case do you think that you will file if your time for getting your grievances redressed is barred by limitation.

Well you can look for an advocate of your choice by using your own prudence , no doubt there are almost one lakh lawyers in Chennai and its surroundings.

Yes true. I had a false hope on the management that they will re examine the case and time to time they were telling it is under consideration and process. Ok sir my faith hope and ordeal won't go waste. Justice is important decades are not. In india many cases timely filed cases are still pending in high and supreme court for more than two  decades. Whether the charges are proved as per our judicial system and government guidelines.

Before moving to any court/tribunal you are required to explore all remedies available to you, you should first file an appeal with appellate authority of the PSU for consideration and passing appropriate order.
