Grandson can claim gifted property of grandfather

grandfather gifted his self aquired property to his 2 sons in 2007 when he was alive.my grand father presnt no more(died in 2009).my father got second marriage without divorce.iam first wife~son. he didnot want to give that gifted selfaquired property to me and my sister. he told that property was gifted to me only,i have a full rights. he only favourable to second wife and her children only.. me and my sister can claim on gifted property.there is any judgements like this cases. plzzz answer in right way.. thank you

It is beleived that the gift deed was registered.

The property that is recieved by valid gift deed is of nature self acquired and gift is complete the moment it is accepted by donee.

Donee becomes title holder.

The donee can dispose his self acquired property in anyone's favor.

No one has forced share in it.

So far it seems your father has not disposed his property.

Better your rapport/goodwill/relations despite what all has happenned.

Involve elders of the family and try to resolve amicably.

After all you are also his flesh and blood.

based on the facts, if everything is done by procedure, it becomes SELF acquired of your father and he has rights to make a decision..MOVE ON

Once property is gifted then the same become the property of donee so you can not claim your grand father property as the same excusively belong to your father anf his brother to whom your grandfather had gifted the property.
