Hostile Witness

in one matter, a employee of the company earlier supported to the Company. after he left the job he had some conversation recording with opponent party which was supporting the opponent party.

this ex-employee approached the company now that he was threten by opponent party and hence forced to do so. he is willing to support and ready to give an affidavit.

however, will his affidavit is going to help as was earlier supporting to the opponent party and had been submitted fact in his favour.

 

what is procedure to take evidence from such hosite witnesses

Before which authority does the Company want the ex-employee to depose ? If it is just for formality/future safety then an Affidavit of the ex-employee stating all facts would suffice ...... If some court case/s are pending then he can personally be present and give his testimony ....
