I would want to understand the laws of inheritance in the Hindu Nair Community in Kerala.
My Late Grand mother has a property which was acquired as a gift.She has 7 children and few grandchildren through them.The property is still unpartitioned and in her name after her demise on 6th August 1975.
Some of the granchildren claim that they would also have the share to the property as per Marumakathayam law and since they were born before the year 1976.The claim is that even children of Grandchildren born before 1976 have rights to the property since it is Thavazhi property.
Could you please enlighten me if the Grand children and all children born before 1976 would have rights to the property and would receive equal shares in the event that the property is disposed?
Would the property be classified as Ancestral property?Would only the 7 children have rights to the property?
Kindly excuse me if I have not used the correct legal terminologies as i am naive to it.
