Is review petition possible before state consumer forum?

Dear Sir,

 

This refers to a judgement of Tamil Nadu state consumer forum.

 

This refers to a consumer case over levy of service tax on 'construction of residential complex'.

 

After the judgement which went against me I came across a service tax tribunal CESTAT judgement stating service tax on the type of services I contacted are not leviable.

 

The state consumer forum judgement is recent and has not passed any time limitation.

 

The judgement can be overturned in view of CETSAT judgement.

 

Is any review/revision petition possible in state consumer forum itself? Is the only remedy ncdrc appeal? Pl. advise.

 

My advocate here says no review/revision in state consumer forum and the only remedy is ncdrc appeal.

 

Pl. quote the act provision/rules/judgements/rulings in support of your contention.

As per Consumer Protection Act, SC has no power to review only NC (sec.22) has the power to review. You may r file a revision petition before NC.
