Is video reply for nri possible for tenant eviction case?

Respected Sir, Madam,

 

order iwas given in our favour  in Tenant case. Now the person whom was given POA is not available to attend case due to sickness.

 

Is it possible to follow the  Eviction case staying abroad or by Video ? How long will it take? Can the Lawyer be given POA?

 

Kindly shed some light on this. Your  replies are much appreciated and thanks in advance .

WE ARE HANDLING A SIMILAR CASE, WE APPLIED FOR EVIDENCE THROUGH VIDEO CONFERENCING, COURT DECLINED THE APPLICATION ON GROUND, THAT THERE ARE NO FACILITIES AVAILABLE AND INSTEAD PERMITTED EVIDENCE THROUGH POA.

IN YOUR CASE, YOU HAVE THE FOLLOWING CHOICES:

 

1.  APPLY APPLICATION FOR EVIDENCE AND CROSS EXAMINATION THROUGH VIDEO CONFERENCING.

    ( THERE ARE VERY DETAILED GUIDELINES IN FAVOUR AVAILABLE IN A JUDGEMENT BY DB OF DELHI HIGH COURT)

2.  OBTAIN A FRESH POA

Hii Santhi,

The Courtsalone have the discretionary powers of whether to allow video conferencing or not.

It all differs from case to case. ecently in a case at nagpur i filed a petition for video conferencing from hyderabad and the court allowed our petition through video conferencing as the respondent is sick and could not travel, hence i advice you to apply for video conferencing and you could succeed.
