Maintainance calculation given to wife from husband salary

Hello All,

I presently earn around 60000 per month .out of which I pay EMI of Rs 18500 per month (for property which I purchased in Mumbai ) .Currently my Mom is staying in that home and I go every weekend to Mumbai .

My working location is in Pune . I have taken a Flat on Rent for Rs 12000 .MY expendiditure in Pune goes upto 12000 inculsive all + I pay 2000 monthly LIC .

So total Expenditure (18500+12000+2000 ) == 32500

My Wife is currently not working (but she use to earn for past 6 months an amount of 3000 per month )

She is educated (BA, MA, BEd in Hindi ) .

How will be the calculation of the Maintainance to Wife in above case and what will be the approimate amount according to you ..

2) Question is Maintainance is claimed only after divorse or still between the divorse .Kindly let me known the answers

Sorry I forget to mention total expenditure which is as below .

18500 -- EMI for home loan

12000 for Rent in pune house

12000 My expendiditure

2000 LIC policy premium payment .

So total Expenditure is 44500 out of 60000.

Let me known how much maintainance can be claimed here

Could you please let me known if wife files a false dowry case on me .. Just to harrase me how could i get rid of it ..

My next question is if a Wife tries to files a false dowry case on me .

What will be action taken by police . (Will i be directly arrested after the case filing )

If at all police arrest me what steps should I take in advance to avoid this kind of stituation .

I am yet to file a Divorse case against her .But avoid everyday battle I am planning to file one

MR SAM, Please read it carefully I said sheis earning 3000 monthly .... and I am not saying that I will give her 3000 .

I have asked the question in forum that I earn 60000 per month and my expendidutre is as follows .

18500 EMI for home loan

12000 for rent where I work that is pune

12000 rs my eating , commutation from Pune to Mumbai ever weekend .

So court may grant how much maintainance to her this is my question try to understand it

Is the EMI on home loan pre-existing liability?

Only if it was so, the same would be deducted to calculate your monthly income and based on that your other expenses notwithstanding the maintenance would be calculated.

The law states that you can not continue to live in luxury, when your wife is a destitute and on the verge of starvation.
