Maintenance & legal liabilities

Dear All,


Does anyone have the judgement of Bombay High Court or any other court which states that maintenance should be granted after considering the legal liabilities like Home Loan EMI and other deductions if any..


Also I am paying a Home Loan EMI which was taken prior to my marriage. My wife has claimed a Residence Rent order. Can the court say that since you are paying EMI then give half of that EMI amount to your wife towards rent for residence.

My salary is Rs.22,000/- per month without deductions. After paying Rs14,000/- as home loan EMI, I am left with Rs.8,000/-. How much will be the approximate maintenance and residence rent order passed. I am the sole earning member of my family and have my father, mother and a younger brother who are dependant on me.

Hello Anis,

Court can not compell you tp pay half of te EMI amount to your wife.What is left after deducting the legal liabilities of yours you need to pay out of that it means out of 8000/- Rs.
